Press Release: Unauthorised use of Attard Baldacchino Brand and License Number AKM-BALD by Third-Parties

This publication is being uploaded to explicitly and publicly distance Dr Russell Attard Baldacchino, the Attard Baldacchino brand, and Community Malta Agency License AKM-BALD from the unauthorised use of Dr Attard Baldacchino’s name, brand, and/or license number by any third parties on any website, publication, email, newsletter or format whatsoever.

It is to be known publicly and to all that no permission or authorisation has been granted by Dr Russell Attard Baldacchino, license holder AKM-BALD, in 2025 to any third parties to engage in any promotion whatsoever of the Malta Citizenship for Exceptional Services by Direct Investment Regulations, nor has any consent been granted to any third parties to display any reference to the Attard Baldacchino brand or license number AKM-BALD on any material, written content, or publications.

More specifically, Dr Russell Attard Baldacchino would like to publicly distance himself from a newsletter that was sent out by a third-party company between the 2nd and 3rd of May 2025, which included a very brief overview of CJEU’s decision in Case C-181/23, comments on Malta’s position, and concludes by encouraging prospective clients to take immediate action.

The newsletter in question included the unauthorised use of the license number AKM-BALD, while Dr. Attard Baldacchino was never asked for permission by the third party to use the AKM license number in the newsletter sent out, nor was he made aware in advance that such a newsletter or its contents would be sent out by the third-party company. The wording and promotional nature of the newsletter in question do not align with the values and principles adopted by the Attard Baldacchino brand, nor is it representative of Dr Russell Attard Baldacchino’s thoughts or opinions.

Dr Russell Attard Baldacchino strongly disapproves and condemns any efforts that attempt to make use of the CJEU Case C-181/23 judgement to promote the same version of the Regulations that have been rendered contrary to EU law by the Court of Justice of the European Union.

In light of the judgement of the Court of Justice of the European Union in Case C-181/23, Commission v Malta (Citizenship by investment), Dr Russell Attard Baldacchino notes the Government of Malta’s press release stating that the Government of Malta respects the decisions of the courts, while at this moment the legal implications of this judgment are being studied in detail, so that the regulatory framework on citizenship can then be brought in line with the principles outlined in the judgment.

Whilst closely monitoring any developments from the Community Malta Agency and the Government of Malta, as of the date of the CJEU’s decision in Case C-181/23, Dr Russell Attard Baldacchino has not and will not engage any new clients under the current version of the Regulations in question.
